Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by thueVPS ("thueVPS", "we", "us" or "our"). By ordering, accessing or using any of our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Acceptance of terms

By creating an account, placing an order or using any thueVPS service, you confirm that you have read, understood and agree to these Terms, along with any policies referenced within them. If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

2. Services and provisioning

thueVPS provides virtual private servers (VPS), dedicated servers, colocation and related infrastructure services. We aim to provision most services promptly after your order is confirmed and payment is received. Provisioning times may vary depending on the service, verification requirements and resource availability.

We reserve the right to refuse, suspend or cancel any order at our discretion, including where an order fails verification, appears fraudulent or would violate these Terms.

3. Billing and payment

Services are billed in advance on a recurring basis, typically monthly, unless a different billing cycle is stated at the time of order. All prices are listed in Vietnamese dong (VND). You agree to pay all fees for the services you order at the rates in effect for your billing cycle.

  • Prices are quoted in VND. When you pay through PayPal, the amount is converted to your payment currency at the exchange rate applied by PayPal at the time of payment; any conversion fees are your responsibility.
  • Invoices are issued before the start of each billing period and are due on the date shown on the invoice.
  • Services may be suspended or terminated if payment is not received by the due date or after any stated grace period.
  • We do not offer free trials. Service begins once payment has cleared.
  • You are responsible for keeping your billing and contact information accurate and up to date.

4. Refunds

Because each server is provisioned individually with dedicated resources and a clean, ready-to-use IPv4 address, fees are non-refundable once the server has been delivered. By placing an order you acknowledge that no refund will be issued after the server has been set up and the login details have been sent to you, except where a refund is required by applicable law.

5. Chargebacks and payment fraud

Filing a fraudulent chargeback or PayPal dispute, for example using the service for a period of time and then falsely claiming the payment was unauthorized in order to reclaim it, is treated as fraud and a serious breach of these terms. In such cases your account and all associated services will be terminated immediately without notice, and we will not respond to or process any further requests or appeals from that account.

The IPv4 address handed over with your server is clean at the time of delivery. You are responsible for how the address and server are used from that point onward.

6. No long-term contract

Our standard services are provided on a recurring basis without a mandatory long-term commitment. You may cancel your service effective at the end of your current billing period, subject to the cancellation process described in your account. Cancelling does not entitle you to a refund of fees already paid for the current period unless otherwise required by law.

7. Acceptable use

You are responsible for all activity that occurs on or through your services, including the actions of anyone you allow to access them. You agree to use our services only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of our services by, any third party.

8. Prohibited uses

The following activities are strictly prohibited. This list is illustrative and not exhaustive:

  • Sending unsolicited bulk email (spam) or operating any service that supports spam, whether the messages originate from our network or elsewhere.
  • Any illegal activity, or the storage or distribution of illegal content, under applicable law.
  • Distributing malware, launching denial-of-service attacks, port scanning, or attempting to gain unauthorized access to any system or network.
  • Phishing, fraud, identity theft or other deceptive practices.
  • Infringing intellectual property rights, including hosting or distributing pirated or unlicensed material.
  • Hosting content that is defamatory, harassing, or that promotes violence or exploitation.
  • Any use that consumes network or system resources in a way that disrupts service for other customers, or that abuses shared infrastructure.

We may investigate suspected violations and may suspend or terminate services involved in prohibited activity, with or without notice depending on the severity of the issue.

9. Software and licensing

You are responsible for ensuring that any software you install or run is properly licensed. Windows and other commercial operating systems or software licenses are not included with our services by default and follow a bring-your-own-license (BYOL) model unless explicitly stated otherwise at the time of order. You agree to comply with all applicable license terms for any software you use.

10. Your responsibilities

You are responsible for the security of your account credentials, the configuration and maintenance of your servers, and the backup of your own data. While we operate reliable infrastructure, you should maintain independent backups of any data you cannot afford to lose. You are also responsible for keeping your operating system and applications patched and secured.

11. Service availability

We work to keep our services available and reliable, but we do not guarantee uninterrupted or error-free operation. Services may occasionally be unavailable due to maintenance, upgrades, or factors beyond our reasonable control. Where scheduled maintenance is planned, we will make reasonable efforts to provide advance notice.

12. Limitation of liability

To the maximum extent permitted by applicable law, thueVPS shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, business or goodwill, arising out of or in connection with your use of, or inability to use, our services. Our total liability for any claim relating to the services shall not exceed the amount you paid to us for the affected service during the billing period in which the claim arose.

Our services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, except as expressly stated in these Terms or required by law.

13. Suspension and termination

We may suspend or terminate your services, in whole or in part, if you breach these Terms, fail to pay fees when due, or engage in prohibited activity. Where practical and appropriate, we will provide notice, but we may act immediately where the situation involves security risks, legal obligations or abuse that affects others. Upon termination, your right to use the services ends, and we may delete data associated with the terminated service.

14. Changes to these terms

We may update these Terms from time to time to reflect changes in our services, technology, legal requirements or business practices. When we make material changes, we will update the version shown here and, where appropriate, notify you. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms.
